Version: ltd-1 · Effective: from the date on which the operation of the BlazeHost services is transferred to BLAZEHOST LIMITED (clause 15.1 of the Terms)
The Czech version of this document is binding; the English version is a translation. If the language versions conflict, the Czech version prevails.
1.1. This acceptable use policy (the "AUP") sets out how the Customer may use the BlazeHost services provided by BLAZEHOST LIMITED, Company number 17523509, registered office 27 Old Gloucester Street, London, WC1N 3AX, United Kingdom (the "Provider"), and how the Provider proceeds in the event of a breach of these rules and when assessing illegal content.
1.2. The AUP forms part of the Contract under the General Terms and Conditions (the "Terms"). Capitalised terms have the meaning given in the Terms.
1.3. Notices of illegal content, contact points and remedies against the Provider's decisions are governed by the document Operator, Contact Points and Abuse Reporting (https://billing.blazehost.cz/legal/legal_notice_abuse).
2.1. The Customer may use the Services only in accordance with the law, the Terms, this AUP and good morals. The Customer is responsible for all content and software that it operates, stores or distributes within the Service, including where it makes the Service available to third parties (e.g. players, website users).
3.1. It is prohibited in particular to:
a) store, distribute or make available illegal content, in particular child sexual abuse material, content inciting violence, terrorism or hatred, content infringing intellectual property rights (copyright, trade marks) or the personality rights of third parties;
b) carry out or support attacks on computer systems and networks, in particular DoS/DDoS attacks, scanning ports and vulnerabilities of other systems without permission, attempts at unauthorised access (hacking, brute force), traffic interception or IP address spoofing;
c) distribute malware, operate botnet command-and-control servers, phishing sites or other fraudulent content;
d) send unsolicited commercial communications (spam), or operate open mail relays or proxy servers that can be misused to distribute spam;
e) mine cryptocurrencies (cryptomining), except on dedicated servers where the Provider has given prior written permission (e-mail suffices);
f) overload the shared infrastructure in a way that endangers the provision of services to other customers, or circumvent the technical limits of the Service;
g) process personal data in breach of the law, in particular Regulation (EU) 2016/679 (GDPR), the UK GDPR and the Data Protection Act 2018;
h) resell the Services or provide them to third parties as the Customer's own hosting service without the Provider's prior written consent (e-mail suffices); this does not affect making the Service available to the Customer's players or users under clause 2.1;
i) use the Services for any other activity contrary to the laws of the United Kingdom, of Germany, where the Services are physically operated, or of the state in which the Customer is established.
4.1. The Customer must secure the Service appropriately for its purpose (software updates, strong passwords, access security) so that it cannot be misused by third parties.
5.1. The Provider is a provider of hosting services within the meaning of Regulation (EU) 2022/2065 on a Single Market for Digital Services (the "DSA"), as it offers its services to recipients in the EU. The Provider does not actively monitor content stored by Customers and has no general obligation to monitor it.
5.2. Assessment. The Provider assesses notices submitted under the document Operator, Contact Points and Abuse Reporting in a timely, diligent, non-arbitrary and objective manner. It does not use automated means for decision-making. Before deciding, the Provider may invite the Customer to comment or to remedy the situation, unless delay would cause serious harm.
5.3. Measures. Depending on the seriousness of the breach, the Provider may in particular: warn the Customer and request a remedy; disable access to or remove specific content; temporarily restrict network traffic; suspend the Service; suspend the customer account; terminate the Contract; refer the matter to the competent authority. Measures must be proportionate. Where a criminal offence threatening the life or safety of persons is suspected, the Provider informs the law enforcement authorities of the EU Member State concerned (Article 18 DSA) or, where applicable, the competent authorities of the United Kingdom.
5.4. Suspension for other reasons. The Provider may also suspend or restrict a Service or customer account where damage to the infrastructure or to the rights of third parties is imminent (clause 6.5 of the Terms), and in the event of an attack threatening the infrastructure or other customers it may temporarily restrict traffic to the target IP address (clause 5.5 of the Terms).
5.5. Statement of reasons (Article 17 DSA). The Provider informs the Customer by e-mail of every restriction of a Service or account on grounds of illegal content or a breach of the Terms or AUP no later than when the restriction is imposed, stating the measure taken, the decisive facts, whether the measure is based on a third-party notice, the legal or contractual ground and the available remedies. The Provider informs the notifier of its decision.
5.6. Remedies. An objection against a decision may be lodged under the procedure in the document Operator, Contact Points and Abuse Reporting.
5.7. The Provider may decline to process notices that are manifestly unfounded or submitted repeatedly and abusively.
5.8. In the event of a material breach of the Contract, in particular a serious breach of clause 3 of the AUP, the Provider may withdraw from the Contract with immediate effect (clause 7.3 of the Terms).
6.1. The Customer is liable to the Provider for damage caused by a breach of the AUP, including the costs of handling the incident and sanctions imposed by third parties (e.g. listing of IP addresses on a blacklist).
6.2. Unavailability of a Service caused by suspension under this AUP is not a defect of the Service (Complaints Policy).
7.1. The AUP may be changed under the procedure for changing the Terms (chapter 12 of the Terms).
